When federal agents raided a chain of Chuy’s Restaurants across Arizona and California, more than 40 illegal aliens were arrested, along with several of the chain’s top executives were arrested, including the father-and-son owners and their accountant. Yes, LA RAZA & CO will scream and moan, but the illegal aliens apprehended here, aren't the victims. Neither are the business owners accused of breaking the law. The real victims are the legal employees whose jobs will be lost because their employer refused to obey the law.

A federal judge released the three business leaders who allegedly masterminded the restaurant chain’s scheme to operate with a crew of illegal aliens. Worse still, the three were released without so much as bail or bond. On their own recognizance, they have simply promised to show up again at a future date for their next court hearing. This is the same promise the Obama Administration routinely makes criminal illegal aliens arrested in the United States make before releasing them again onto the streets and into our communities.
Put aside, however, any questions as to whether the “Chuy’s Three” will show for their next court date. Put aside for a moment any questions you might have about how many of the 40+ criminal illegal aliens arrested in this operation will likewise be out on the streets again in a matter of days or weeks with little or nothing more than a promise that they, too, will come back again to face punishment for their crimes.
For the moment, please consider the most direct, but least mentioned victims: the American citizens who routinely lose their jobs in companies disrupted, or even closed, when they are caught breaking the law. These criminal enterprises are no better than fake businesses set up to launder drug money, and they damage they do to the communities in which they operate can be as bad, or worse.
Azfamily.com covered this story and interviewed a legal employee, Rachel Schooley, who would lose her job due to the closure of the restaurants. She had worked there for eight years, is a mother and is expecting another child soon. In today’s economy, her prospects of finding a new job will likely prove difficult.
The same businesses which lobby Congress and state legislatures across the nation for relaxed immigration laws, for focus on the budget instead of illegal immigration, and against Arizona conservatives who support measures like Arizona’s SB1070 and Georgia’s tough new law, have a responsibility to better police their own neighborhood.
Chambers of Commerce and other similar organizations are, of course, free to lobby for whatever they deem in the best interests of their members, but they do our cities, states and nations a tremendous disservice when they make villains out of those who are working to enforce the law – while doing seemingly little to protect those jobs which will be lost when businesses criminally hire illegal workers.

With just one signature, Gov. Brewer can change the American political landscape.
HB 2177 has already passed the Arizona State House and State Senate. The legislation would require candidates for the highest office in the land to prove their qualifications.
Among those qualifications, candidates for United States President must have been born in the United States – or at least on a military base near the Panama Canal, in Sen. John McCain’s case.

Alas, despite having been elected, Mr. Obama has seen fit to show little proof to the American people that he is, himself, an American. At least by birth. If he was born in Hawaii, where is the certificate? Why do their seem to be more people in Kenya who remember his birth than here in America?
Whatever the case, it is not for us at BAN AMNESTY NOW or the Conservative Leadership Coalition to judge. We aren’t about the candidates, we’re only about the issues. In this case, the issue is good government, honesty in public service and transparency in politics.
It may be easy to criticize Mr. Obama for refusing to produce his credentials, but the fact is, the American presidency is one of the foremost seats of world power. The U.S. Constitution explicitly states what qualifications must be met for a candidate to run.
We should herald the passage of HB 2177 in Arizona, and call for its quick passage in all 50 states, because without bringing harm to any individual it further strengthens the trust the American public can and should have that our system is still working after more than two centuries.
With that in mind, we fervently hope that Governor Brewer will sign HB 2177 into law and ask likeminded Americans from across the nation to contact her office and encourage her accordingly.

- It has been too long since President Obama too the oath of office and said he would abilde by the Constitution of the United States of America. It is evident that he feels he is exempt from following the necessary protocols that everybody else has to become the leader of our nation. He is arrogant and doesn't lead very well. In fact, he has made a travesty of the Oval Office and what it represents. If he has evidence of being born in the United States then let him show it. It is suspicious that he has not complied and therefore is feeding the frenzie that he is an imposter. Please let this law pass and give our country back the feeling of security and honor.

- Thank you Representative Elton Gallegly (R-Cal.), for your support & position on this extremely critical issue. The public has learned over the past ten to twenty years that all the talk about attrition not working, was pure political bull. Attrition was summarily & arbitrarily dismissed by those who wanted the subject matter to move on to another subject. Opponents knew then as they know now, attrition works, & may work better than any other method. Far too many political types & business types stand to gain &/or profit personally from illegal immigration. Whether its employees for their own businesses or for their campaign donors businesses, or even perhaps gain from the trafficking of human beings or even worse the traffic in illegal drugs, amnesty & an unprotected, unsecured southern border w/ Mexico, apparently is in the interest of the 'powers to be.' Its shameful. Its illegal. Its immoral! So thank you for sticking w/ us. We refuse to accept amnesty. Build the originally proposed & planned double layered fencing system w/ intermediate access road for BP Agents to traverse. Where built, all 120 miles of it along the nearly 2,000 mile border, it works best of any installation. Years of evidence proves this. No fence means an amnesty would cause a massive inrush of additional illegal aliens. Slowing or stopping the drugs would save America hundreds of billions. Plus, imagine northern Mexico. If the drug cartels cannot make money there, they will go back to their plantations & try to figure another way in. That would save the people of Mexico. BTW.... we know Mexico is building their own fencing system. Yep, we found out about it!!! Now, that their fencing system is being erected along their southern border w/ Guatemala, is not the issue. The fact that Mexico who ridiculed & mocked America over her fence is also building one, exposes the vulgar hypocrisy of the accusations leveled against Americans. Ridicule & mockery in our our congress where liberals stood & applauded the man's hypocritical words attacking America for protecting herself! It is despicable in the extreme. Its time Washington, including Republicans who truly honor the citizens of this nation, to do the right thing & build the fence, prosecute employers of illegal aliens, require the E-Verify system, deport illegals caught working, deport their families as well, including their children who are minors & should not be dumped on this nation as an anchor to weasel their way back in, plus end the birthright citizenship game. No law ever called for it. Only a liberal; jurist called for it. The constitution does NOT call for it. Those parents are NOT under the jurisdiction of America, so neither are their children, no matter when born. I hate to say it this way. The government has lost the trust of the people. Halfway measures will be seen as another attempt to dupe us. The Washington establishment is as intent on passing amnesty disguised as “comprehensive immigration reform” as it was three years ago.
A group of US Senators, working with the full support of the White House, and the pro-amnesty, open-borders crowd, is once again pushing for so-called “comprehensive immigration reform” including granting amnesty to illegal aliens who broke the law coming to the United States and continue to break the law each and every day by staying.

Back in 2007, when I served as Executive Director of the Arizona Republican Party, we helped lead led a united effort of ten state Republican Parties (Arizona, Colorado, Delaware, Iowa, Maryland, Michigan, New Jersey, North Dakota, South Carolina and Texas) against the McCain-Kennedy amnesty scheme.
The media dubbed us the “Rogue State Parties”, though the McCainiacs and pro-amnesty Republicans called us much worse. We weren’t alone for long.
Leading to the bill’s eventual demise, literally millions of emails, phone calls, faxes and letters from Americans across the nation would reach Congress. Add to that the patriots who, themselves, visited office after office of Members of Congress making their voices heard.
Last year, I launched BAN AMNESTY NOW. Already we have become the nation’s fastest growing grassroots anti-illegal immigration, anti-amnesty organization. We count nearly one-million Americans among our supporters: citizens who have contributed, signed petitions, sent emails, joined on Facebook, or otherwise supported our efforts.
We have worked hard alongside some of the nation’s most ardent defenders of border security and law enforcement and opponents of illegal immigration and amnesty.
From building support for Arizona’s landmark SB-1070 and opposing the Obama lawsuits to helping stop the nightmarish, amnesty scheme known ironically as the “Dream Act” not once, but twice!

Once again, it will be up to us – the American people – to stop amnesty for illegals in Washington.
Already the media has dubbed this new scourge “Grahamnesty” after chief proponent Lindsay Graham, US Senator from South Carolina. Illegal is illegal – and amnesty is amnesty.

Instead, they’re looking to a strange-bedfellows mix of conservative and liberal constituencies that can provide a “safety net” of support, as Graham put it, once the issue heats up.
“It’s in the infant stage,” Graham told POLITICO. “I don’t know what the political appetite is to do something.”

"The actions of the Administration (including Senators/Reps) and the fact that the border is WIDE OPEN is undeniable proof that the war on terror is a fraud. It's a huge lie. So that being said, it's safe to say that you sir, are either on the wrong team or believe what the liberal media feed you. Either way when making comments regarding any war on terror you end up looking like a fool as there is no war on terror. Don't need to hear about casualties because there is a war going on for sure. Sheriff Joe Arpaio’s most recent crime suppression sweep nabbed 83 criminals, including 68 illegal aliens believed to be in the United States involved in human smuggling. In the days leading up to the most recent sweep, according MyFOXPhoenix, another 56 illegal aliens in the human smuggling business were also arrested. The total: 124.

The total: 124.With every crime suppression sweep announced by Sheriff Arpaio’s office, the liberals come out of the woodwork to protest, picket, whine and complain. There are placards of Sheriff Joe with Hitler-like moustaches. There are cries of racism. There are rants and raves as vitriolic and silly as anything you’ve ever witnessed in politics. And they never seem to stop.
Does this mean liberals support human trafficking and smuggling? Here’s what ICE has to say about the subject:
“Human smuggling and human trafficking are two of the most heinous crimes that ICE investigates. In its worst manifestation, human trafficking is akin to modern-day slavery. Victims pay to be illegally transported into the United States only to find themselves in the thrall of the traffickers. They are forced into prostitution, involuntary labor and other forms of servitude to repay debts – often entry in the United States. In certain cases, the victims are mere children. They find themselves surrounded by an unfamiliar culture and language without identification documents, fearing for their lives and the lives of their families.”
Let’s not revisit the subject that a Republican president (Lincoln) took the nation to war to end slavery against the Democrat-controlled, pro-slavery South. Or how, until he passed away, a former “kleagle” (recruiter) for the Ku Klux Klan was routinely elected to the Democrat leadership of the United States Senate (despite his use of the “n-word” on national television). This isn’t supposed to be one of those columns.
This article is about how liberal activists and the liberal media are so determined to attack a person (Sheriff Joe Arpaio) that they will find any excuse to vilify any and every action he undertakes.
Suggesting Sheriff Arpaio and his supporters are racist because they want to stop human trafficking into Mexico may be good fodder for desperate liberal activists. But look at it this way: if it were Albanians or Irishmen or a gaggle of deviant Canadians running human smuggling across the Arizona border into Mexico, Sheriff Joe would be just as determined to stop it. That most of the individuals involved are Mexican isn’t surprising: it’s Mexico.
Human trafficking and smuggling is today’s extension of slavery. It isn’t just happening across the Arizona-Mexico border, but in trouble-spots all around the world. The wingnuts who spend their time attacking Sheriff Joe are doing a tremendous disservice to the victims of these crimes because the media often forgets to tell their story.
Slavery ended in America before my family would come to the United States (legally, I’ll add). But as an American, I am ashamed to see the liberal-Left play politics with such a scarring tragedy that should never again be tolerated in this, or any, nation.

Every concern they have is against wellbeing and concerncerns for the citizens of this country as well as for the welfare of the citizens of other countries that are being used and abused here. People are concerned about the trafficing of illegals through the desert and the mountains, yet they are not concerned about stopping the trafficing of these people. There are drug tunnels in San Diego, and other border towns for the cartels to use, yet, where and when are they going to be shut down? When there usefulness are done? How about the drug farms and the drug camps in the US Forests manned by the cartels soldiers? No US soldiers have been sent in there to clean them out, yet the US citizens are warned to stay away from forests. In the days since Jared Lee Loughner seriously wounded Congresswoman Gabrielle Giffords and killed six others, including a federal judge and a 9-year-old girl who, we’ve since learned, had been born on September 11, 2001, many of us in the so-called “right” have been on the defensive. Rush Limbaugh, Sarah Palin, conservatives and the “right wing” have all been blamed by liberal commentators, members of the media, and politicians for the tragic attack. We have all been blamed because of our tireless, vigilant voice against a government out-of-control and a liberal media run amok.

And ironically, it was supposed to have been OUR rhetoric which created the atmosphere which led to the shooting, not theirs.
On January 12, 2011, President Obama joined state and federal lawmakers, friends and family of the victims of the recent Tucson shooting, and thousands of citizens looking for healing, hope, solace and even closure. At the memorial service, in his speech, Mr. Obama spoke around the issue of blame for the tragedy. He neither chastised his fellow liberals for their outrageous political attacks not defended those of us who have weathered them. But he said something important: “I believe we can be better.”
I believe we can be better, too.
I believe we, as a nation, can be better if we focus on the issues and challenges we must confront, rather than the people themselves who may disagree with us.
I believe we can be better advocates for our positions, and as such, we can win victories for our causes. And I believe we can make our states and our nation safer and more prosperous as a result.

I believe we can do better – and I hope others can, as well. Passion in politics and political discourse should be applauded, but when our opponents and the left resort to threats, name-calling and worse, their desperation is evident and they are hurting their own cause.

The Department of Homeland Security is designed to keep our borders strong, our country safe, and to enforce our immigration laws. Under Obama and Janet Napolitano, however, the DHS is not guided by any of these key values, but rather, by their own self-serving agenda... regardless of how unfair that agenda is to U.S. citizens. Recently, Napolitano actually went so far as to claim that Congress must pass the DREAM Act because the DREAM Act will make our borders stronger and will allow DHS to "do its job of enforcing the nation's immigration law."
The Obama administration’s indifference to securing our borders, willingness to pander like shameless puppies to illegal aliens, and unconditional commitment to promoting amnesty is becoming more and more obvious (as well as more and more damaging). In the spirit of honoring both our current laws and the will of the people, DHS should forcefully condemn the DREAM Act. The DREAM Act will provide amnesty to millions of illegal aliens who can then petition to grant their family members citizenship. The DREAM Act will irreparably bankrupt this nation. The DREAM Act will unquestionably increase illegal immigration and weaken the security of our border. The DREAM Act will increase the presence of human smugglers. The DREAM Act will make it harder for Americans to get jobs, legal students to attend colleges, and U.S. families to pay for their children’s education. As Iowa Rep. Steve King stated, the DREAM Act is a “20 billion dollar giveaway to illegal aliens”… the DREAM Act is also a slap in the face to all the legal citizens of this nation.

In addition to suing the state of Arizona, Obama's Justice Department has given over $60 million to Sanctuary Cities across the United States. In this year alone, Obama’s Justice Department has funneled approximately $62.2 million into cities, counties, and states that offer sanctuary to illegal aliens.
In their new report “Subsidizing Sanctuaries: The State Criminal Alien Assistance Program,” the Center for Immigratio Studies reveals yet another one of President Obama’s disturbing, secretive, back-door schemes that serve to help out illegal aliens and their allies. In this year alone, Obama’s Justice Department has funneled approximately $62.2 million into cities, counties, and states that offer sanctuary to illegal aliens.
What is absolutely unacceptable and ridiculous is that Sanctuary Cities (San Francisco, Chicago, Seattle, New York, to name a few) refuse to enforce immigration laws but then get this extra money from the Department of Justice to “deal with their large populations of illegal aliens!” These cities laugh in the face of American immigration laws, thus attracting a large illegal alien population, and then get bonus money to deal with their illegal alien population! Anyone else see something terribly unjust with this picture?
Sanctuary Cities get money. The illegal aliens who live there benefit from the money—which of course comes from taxpayers. And what do states that try to do something about immigration get? They don’t get additional funding to combat illegal immigration, no, they get sued by the Obama administration! The DOJ is suing Arizona for cracking down on illegal immigration while doling out over $60 million to cities who refuse to do anything to stop our illegal immigration epidemic!
It is time to stop federal funding to Sanctuary Cities; they should be punished for refusing to enforce U.S. laws not rewarded by Obama's DOJ. It is time to take back our country and end Obama’s dangerous amnesty schemes!

In Wheatridge, Colorado, Damacio Torres-Ochoa, an illegal alien, attempted to rob 81-year old Joseph Wallace. Instead of standing trial (like any U.S. citizen would have to do), ICE apparently decided Torres-Ochoa was above U.S. law so they allowed him to “self deport” rather than standing trial and being brought to justice.
“Self deporting,” by the way, is a fancy term that means ICE officers flew Torres-Ochoa to El Paso, Texas and then walked him across the border and into Mexico. This instance exemplifies the indescribable and shocking stupidity, incompetence, and sheer indifference of the federal government and the ICE.
The story gets even worse. As Torres-Ochoa and an accomplice were in the process of stealing Wallace’s trailer, Wallace shot at the two men and hit the accomplice. While Torres-Ocho was allowed to “self deport,” Wallace, who was only trying to keep his trailer and protect his property, was charged with “attempted reckless manslaughter”; he is now a felon!
How can we possibly feel proud to live in a nation where this elderly man who was the victim of a robbery gets charged and convicted with serious crimes, while ICE officials charter a plane and escort the illegal alien who robbed him across the border to freedom?
This is an outrage; it is time to stop treating illegal aliens as though they are above our laws and it is absolutely time to start enforcing immigration laws. In Wheatridge, Colorado, Damacio Torres-Ochoa, an illegal alien, attempted to rob 81-year old Joseph Wallace. Instead of standing trial (like any U.S. citizen would have to do), ICE apparently decided Torres-Ochoa was above U.S. law so they allowed him to “self deport” rather than standing trial and being brought to justice.
“Self deporting,” by the way, is a fancy term that means ICE officers flew Torres-Ochoa to El Paso, Texas and then walked him across the border and into Mexico. This instance exemplifies the indescribable and shocking stupidity, incompetence, and sheer indifference of the federal government and the ICE.
The story gets even worse. As Torres-Ochoa and an accomplice were in the process of stealing Wallace’s trailer, Wallace shot at the two men and hit the accomplice. While Torres-Ocho was allowed to “self deport,” Wallace, who was only trying to keep his trailer and protect his property, was charged with “attempted reckless manslaughter”; he is now a felon!
How can we possibly feel proud to live in a nation where this elderly man who was the victim of a robbery gets charged and convicted with serious crimes, while ICE officials charter a plane and escort the illegal alien who robbed him across the border to freedom?
This is an outrage; it is time to stop treating illegal aliens as though they are above our laws and it is absolutely time to start enforcing immigration laws. - I was living in Seattle several years ago when we first started noticing a huge wave of illegal immigrants into the area. Within a year they had taken over our apartment complex and turned it into a garbage dump Syringes and spent sexual aids littering the parking areas and playground. The few of us citizens that didn't move to get away from all of this were mostly disabled or retired and on fixed incomes. Regardless, the owner of the complex (an ex Seattle Mayor) found that he could charge outrageous rents to the illegals and so forced we few remaining residents out and raised the rents. The only people that live there now are Illegals as far as I can tell. As if that were not enough, My daughter was hit while on her bicycle coming home from school,WITHIN THE SCHOOL ZONE, just a block from her high school by an illegal making a right turn on a red light. He didn't even stop at the light let alone look to his right to see her! Although she was not badly hurt, the front wheel of her bike was totaled and the front fork bent which required several hundred dollars to have repaired. He asked her if she were hurt and she said she didn't think so, and he just sped off! She was left to wrestle her damaged bike the rest of the three miles home. As the shock began to wear off, she realized that her back and wrist were hurting and by the time she arrived home, was in need of immediate medical care, So, off to the Emergency Room we went. Although we filed a police report and identified the truck as one we saw along the route we took to town, no arrest was ever made. A week later the rental house where he had lived, was back on the market. I have several stories o tell but the point is that even when they commit crimes, they are not held accountable as any other US citizen would be. It all needs to stop. Secure our borders and deport these criminals because that is what they are. They are breaking the law just being here. Would Mexico give us free medical, dental, HUD housing, food stamps or family aid? I think not! So let's PLEASE stop the insanity and enforce the laws.

In California, a 2001 state law (AB 540) mandates that illegal aliens who attend three years of high school in California get to receive in-state tuition if they attend a CA university. The California Supreme Court is currently reviewing a lawsuit that challenges AB 540. The Supreme Court must do the right thing and reverse this egregious law.
College is extremely expensive and is skyrocketing in price every single year; many U.S. students and their families endure severe financial hardship, even emptying bank accounts, in order to pay for college. While the government does little to help struggling U.S. families, they do create laws to make sure illegal aliens can take advantage of our U.S. universities.
In California, a 2001 state law (AB 540) mandates that illegal aliens who attend three years of high school in California get to receive in-state tuition if they attend a CA university. The difference between in-state and out-of-state tuition is about $19,000.00 each year!
Legal U.S. students from outside of California have to pay $19,000.00 more per year to attend California universities than illegal aliens do! Illegal aliens are not even citizens of the United States – how can they be considered “residents of California?”
In addition, illegal aliens have already freeloaded off of California taxpayers; taxpayers have already funded their elementary, middle, and high school education, why should Californians also have to subsidize their college tuition?
The California Supreme Court is currently reviewing a lawsuit that challenges AB 540. The Supreme Court must do the right thing and reverse this egregious law. To give illegal aliens the significant privilege of in-state tuition, a privilege we do not even grant to all citizens of this country, is an absolute travesty of justice.
We cannot treat illegal aliens better than we treat citizens of this nation; illegal aliens are receiving discounted tuition at top universities while U.S. citizens and their families are going deep into debt and spending money they’ve saved their entire lives to obtain the same opportunities.
In addition to serving as a “slap in the face” to out-of state students who are granted less rights than illegal aliens, AB 540 also puts a crippling, unnecessary (yet avoidable) burden on California tax payers during these rough economic times.
The Los Angeles Times estimates that approximately 25,000 illegal aliens attend California universities and receive in-state tuition. Kris Kobach, an attorney arguing against AB 540, estimates that these illegal aliens cost California—and its taxpayers—more than $200 million dollars annually!
Our government must start recognizing that illegal aliens are criminals. They should be deported and punished, not granted immense privileges at the cost of legal, hardworking U.S. citizens. We punish all other types of lawbreakers and yet we reward illegal aliens, granting them rights we don’t even offer to all U.S. citizens!

- Why would you have any kind of tuition rate for illegals when you have no money in your state. Besides that, there are plenty of our students gettting turned away because they can't afford to go to your schools. Why would you do that to AMERICAN CITIZENS?

Citizens have a constitutional right to expect the protection of federal laws which prohibit unauthorized activities by non-citizens are denied equal protection when a police department or magistrate acts in a manner that encourages or assists persons selected on the basis of nationality or alienage to engage in such unlawful activities.
Illegal aliens are not a suspect class entitled to Fourteenth Amendment based strict scrutiny of any discriminatory classification based on that status, nor are they defined by an immutable characteristic, since their status is the product of conscious unlawful action.
"The statutory law of the United States is part of the law of each state just as if it were written into state statutory law." States do not need a 287g, IGA, MOU or a permission slip to arrest illegal aliens. The 287g goes beyond the arrest powers as states already have inherent authority to make arrests, 287g is for post arrest, not anything to do with authority!!!!
Illegal is not a race, it is a crime. SB1070 simply codifies federal law into state law and remove excuses and concerns about states inherent authority to enforce these laws and removes all so called“sanctuary) policies.

When do we stand up for Americans and the rule of law, if not now? We are a nation of laws, a Constitutional Republic.
Arizona did not make illegal, illegal. Illegal was already illegal. It is a crime to enter or remain in the U.S. in violation of federal law. States have had inherent authority to enforce immigration laws and has failed or refused to do so. Sanctuary policies are illegal under federal law (8 USC 1644 & 1373) yet we have them all over the United States.
Well here in Arizona we are going to enforce our laws, protect our citizens and stand firmly behind the rule of law.
If law enforcement could not stop someone before this law, they cannot stop them now. If you did not have to carry ID before this law, you don't have to carry ID under this new law. We did not expand law enforcement authority or require any "new" requirements or put new conditions on citizens. We simply took the handcuffs off from law enforcement and allow them to enforce our immigration laws, like any other law.
• The new Arizona law mirrors federal law, which already requires aliens (non-citizens) to register and carry their documents with them (8 USC 1304(e) and 8 USC 1306(a)). The new Arizona law simply states that violating federal immigration law is now a state crime as well. Because illegal immigrants are by definition in violation of federal immigration laws, they can now be arrested by local law enforcement in Arizona.
• The law is designed to avoid the legal pitfall of “pre-emption,” which means a state can’t adopt laws that conflict with federal laws. By making what is a federal violation also a state violation, the Arizona law avoids this problem.
• The law only allows police to ask about immigration status in the normal course of “lawful contact” with a person, such as a traffic stop or if they have committed a crime.
• Estimates from the federal government indicate that more than 80 percent of illegal immigrants come from Latin America.12 Thus, there is concern that police may target only Hispanics for enforcement.
• Before asking a person about immigration status, law enforcement officials are required by the law to have “reasonable suspicion” that a person is an illegal immigrant. The concept of “reasonable suspicion” is well established by court rulings. Since Arizona does not issue driver’s licenses to illegal immigrants, having a valid license creates a presumption of legal status. Examples of reasonable suspicion include:
• A driver stopped for a traffic violation has no license, or record of a driver’s license or other form of federal or state identification.
• A police officer observes someone buying fraudulent identity documents or crossing the border illegally.
• A police officer recognizes a gang member back on the street who he knows has been previously deported by the federal government.
• The law specifically states that police, “may not solely consider race, color or national origin” when implementing SB 1070.
• When Arizona’s governor signed the new law, she also issued an executive order requiring the Arizona Peace Officer Standards and Training Board to provide local police with additional training on what does and what does not constitute “reasonable suspicion.”13
Rancher Rob Krentz was murdered by the drug cartel on his ranch a month ago. I held a senate hearing two weeks ago on border violence.
One only had to hear the concerns and pleas from these folks to recognize the monumental failure of government to secure our borders and enforce our laws and the cost to our citizens.
Here are just some of the highlights from those who testified.
The people who live within 60 to 80 miles of the Arizona/Mexico Border have for years been terrorized and have pleaded for help to stop the daily invasion of humans who cross their property. One Rancher testified that 300 to 1200 people a DAY come across his ranch, vandalizing his property, stealing his vehicles and property, cutting down his fences, and leaving trash. In the last two years he has found
17 dead bodies and two Qur’an bibles.
Another rancher testified that on a daily basis drugs are brought across his ranch in a military operation. A point man with a machine gun goes in front, 1/2 mile behind are the guards fully armed, 1/2 mile behind them are the drugs, behind the drugs 1/2 mile are more guards. These people are violent and they will kill anyone who gets in the way. This was not the only rancher we heard that day that talked about the drug trains.
One man told of two illegal's who came upon his property, one shot in the back and the other in the arm by the drug runners who had forced them to carry the drugs and then shot them. They listen to gun fire during the night; it is not safe to leave his family alone on the ranch and they can't leave the ranch for fear of nothing being left when they come back.
The border patrol is not on the border. They have set up 60 miles away with check points that do nothing to stop the invasion. They are not allowed to use force in stopping anyone who is entering. They run around chasing them, if they get their hands on them, then they can take them back across the border.
Federal prisons have over 35% illegals incarcerated, and 20% of Arizona prisons are filled with illegals who have committed felonies. In the last few years, 80% of our law enforcement personnel who have been killed or wounded were done by an illegal alien.
The majority of people coming now are people we need to be worried about. The ranchers told us that they have seen a change in the people coming they are not just those who are looking for work and a better life.
The Federal Government has refused for years to do anything to help the Border States.
We have been overrun and once they are here, Arizonans have the burden of funding state services that they use. Education costs have been over a billion dollars. The healthcare costs for illegal aliens runs into the billions of dollars. Our State is broke; $3.5 billion deficit and we have many serious decisions to make. One is that we do not have the money to care for any who are not here legally. It has to stop.
The border can be secured. We have the technology; we have the ability to stop this invasion. We must know who is coming and they must come in legally so that we can assimilate them into our population and protect the sovereignty of our country. We are a nation of laws. We have a responsibility to protect our citizens and to protect the integrity of our country and the government which we live under.
It will do no good to forgive them because millions more will come behind them, and we will be over run to the point that there will no longer be a United States of America but, a North American Union of open borders. I ask you what form of government we will live under.
How long will it be before we will be just like Mexico? We have already lost our language; everything must be printed in Spanish. We have already lost our history since it is no longer taught in our schools. And we have lost our borders.
The leftist media has distorted what SB 1070 will do. The ACLU, cheap labor advocates and the leftist courts will do everything to protect those who are here illegally, but it was an effort to try and stop illegal's from setting up businesses, and employment, and receiving state services and give the ability to local law enforcement when there is probable cause, such as a traffic stop to determine if they are here legally. Federal law is very clear if you are here on a visa you must have your papers on you at all times. That is the law. In Arizona all you need to show you as a legal citizen is a driver license, MVD identification card, Native American Card, or a Military ID. This is what you need to vote, get a hunting license, etc... So nothing new has been added to this law. No one is going to be stopped walking down the street. The leftists here and in DC are angry because we dare try and do something. They want the "Transformation" to continue.
It is not too late to save America. As an elected official I must try to do what I can to protect our Constitutional Republic. Living in America is not a right just because you can walk across the border. Citizens have a constitutional right to expect the protection of federal laws which prohibit unauthorized activities by non-citizens are denied equal protection when a police department or magistrate acts in a manner that encourages or assists persons selected on the basis of nationality or alienage to engage in such unlawful activities.
Illegal aliens are not a suspect class entitled to Fourteenth Amendment based strict scrutiny of any discriminatory classification based on that status, nor are they defined by an immutable characteristic, since their status is the product of conscious unlawful action.
"The statutory law of the United States is part of the law of each state just as if it were written into state statutory law." States do not need a 287g, IGA, MOU or a permission slip to arrest illegal aliens. The 287g goes beyond the arrest powers as states already have inherent authority to make arrests, 287g is for post arrest, not anything to do with authority!!!!
Illegal is not a race, it is a crime. SB1070 simply codifies federal law into state law and remove excuses and concerns about states inherent authority to enforce these laws and removes all so called“sanctuary) policies.

When do we stand up for Americans and the rule of law, if not now? We are a nation of laws, a Constitutional Republic.
Arizona did not make illegal, illegal. Illegal was already illegal. It is a crime to enter or remain in the U.S. in violation of federal law. States have had inherent authority to enforce immigration laws and has failed or refused to do so. Sanctuary policies are illegal under federal law (8 USC 1644 & 1373) yet we have them all over the United States.
Well here in Arizona we are going to enforce our laws, protect our citizens and stand firmly behind the rule of law.
If law enforcement could not stop someone before this law, they cannot stop them now. If you did not have to carry ID before this law, you don't have to carry ID under this new law. We did not expand law enforcement authority or require any "new" requirements or put new conditions on citizens. We simply took the handcuffs off from law enforcement and allow them to enforce our immigration laws, like any other law.
• The new Arizona law mirrors federal law, which already requires aliens (non-citizens) to register and carry their documents with them (8 USC 1304(e) and 8 USC 1306(a)). The new Arizona law simply states that violating federal immigration law is now a state crime as well. Because illegal immigrants are by definition in violation of federal immigration laws, they can now be arrested by local law enforcement in Arizona.
• The law is designed to avoid the legal pitfall of “pre-emption,” which means a state can’t adopt laws that conflict with federal laws. By making what is a federal violation also a state violation, the Arizona law avoids this problem.
• The law only allows police to ask about immigration status in the normal course of “lawful contact” with a person, such as a traffic stop or if they have committed a crime.
• Estimates from the federal government indicate that more than 80 percent of illegal immigrants come from Latin America.12 Thus, there is concern that police may target only Hispanics for enforcement.
• Before asking a person about immigration status, law enforcement officials are required by the law to have “reasonable suspicion” that a person is an illegal immigrant. The concept of “reasonable suspicion” is well established by court rulings. Since Arizona does not issue driver’s licenses to illegal immigrants, having a valid license creates a presumption of legal status. Examples of reasonable suspicion include:
• A driver stopped for a traffic violation has no license, or record of a driver’s license or other form of federal or state identification.
• A police officer observes someone buying fraudulent identity documents or crossing the border illegally.
• A police officer recognizes a gang member back on the street who he knows has been previously deported by the federal government.
• The law specifically states that police, “may not solely consider race, color or national origin” when implementing SB 1070.
• When Arizona’s governor signed the new law, she also issued an executive order requiring the Arizona Peace Officer Standards and Training Board to provide local police with additional training on what does and what does not constitute “reasonable suspicion.”13
Rancher Rob Krentz was murdered by the drug cartel on his ranch a month ago. I held a senate hearing two weeks ago on border violence.
One only had to hear the concerns and pleas from these folks to recognize the monumental failure of government to secure our borders and enforce our laws and the cost to our citizens.
Here are just some of the highlights from those who testified.
The people who live within 60 to 80 miles of the Arizona/Mexico Border have for years been terrorized and have pleaded for help to stop the daily invasion of humans who cross their property. One Rancher testified that 300 to 1200 people a DAY come across his ranch, vandalizing his property, stealing his vehicles and property, cutting down his fences, and leaving trash. In the last two years he has found
17 dead bodies and two Qur’an bibles.
Another rancher testified that on a daily basis drugs are brought across his ranch in a military operation. A point man with a machine gun goes in front, 1/2 mile behind are the guards fully armed, 1/2 mile behind them are the drugs, behind the drugs 1/2 mile are more guards. These people are violent and they will kill anyone who gets in the way. This was not the only rancher we heard that day that talked about the drug trains.
One man told of two illegal's who came upon his property, one shot in the back and the other in the arm by the drug runners who had forced them to carry the drugs and then shot them. They listen to gun fire during the night; it is not safe to leave his family alone on the ranch and they can't leave the ranch for fear of nothing being left when they come back.
The border patrol is not on the border. They have set up 60 miles away with check points that do nothing to stop the invasion. They are not allowed to use force in stopping anyone who is entering. They run around chasing them, if they get their hands on them, then they can take them back across the border.
Federal prisons have over 35% illegals incarcerated, and 20% of Arizona prisons are filled with illegals who have committed felonies. In the last few years, 80% of our law enforcement personnel who have been killed or wounded were done by an illegal alien.
The majority of people coming now are people we need to be worried about. The ranchers told us that they have seen a change in the people coming they are not just those who are looking for work and a better life.
The Federal Government has refused for years to do anything to help the Border States.
We have been overrun and once they are here, Arizonans have the burden of funding state services that they use. Education costs have been over a billion dollars. The healthcare costs for illegal aliens runs into the billions of dollars. Our State is broke; $3.5 billion deficit and we have many serious decisions to make. One is that we do not have the money to care for any who are not here legally. It has to stop.
The border can be secured. We have the technology; we have the ability to stop this invasion. We must know who is coming and they must come in legally so that we can assimilate them into our population and protect the sovereignty of our country. We are a nation of laws. We have a responsibility to protect our citizens and to protect the integrity of our country and the government which we live under.
It will do no good to forgive them because millions more will come behind them, and we will be over run to the point that there will no longer be a United States of America but, a North American Union of open borders. I ask you what form of government we will live under.
How long will it be before we will be just like Mexico? We have already lost our language; everything must be printed in Spanish. We have already lost our history since it is no longer taught in our schools. And we have lost our borders.
The leftist media has distorted what SB 1070 will do. The ACLU, cheap labor advocates and the leftist courts will do everything to protect those who are here illegally, but it was an effort to try and stop illegal's from setting up businesses, and employment, and receiving state services and give the ability to local law enforcement when there is probable cause, such as a traffic stop to determine if they are here legally. Federal law is very clear if you are here on a visa you must have your papers on you at all times. That is the law. In Arizona all you need to show you as a legal citizen is a driver license, MVD identification card, Native American Card, or a Military ID. This is what you need to vote, get a hunting license, etc... So nothing new has been added to this law. No one is going to be stopped walking down the street. The leftists here and in DC are angry because we dare try and do something. They want the "Transformation" to continue.
It is not too late to save America. As an elected official I must try to do what I can to protect our Constitutional Republic. Living in America is not a right just because you can walk across the border. - I am so completely apposed to the Dream Act and I fear that it will pass the lame duck session. I also can't afford to contribute the dollars to send faxes. If I could I would in a heart beat. Being retired and on a small fixed income makes it impossible to continue contributions to fax. I do write and call my representative. I fear that McCain and Kyl will cave on the Dream Act.

*Shane’s death was described by Chief Harris as a “tragic accident involving an undocumented worker.” In reality, Shane was needlessly killed by a multiple crosser with outstanding warrants who, according to investigators, urinated on the side of the road while Shane’s life ebbed away on the street. Police officers on the front line are committed to the rule of law and are quite black and white when it comes to the rules of engagement. Police officers don’t call a drug dealer an “unlicensed pharmacist.” They don’t call a bank robber an “aggressive borrower with bad credit.” A softened tone for those committing the crime of illegal immigration (8 U.S.C 1325

- Some times Limo service is cheaper than taxis for airport rides. So if you are planning to fly for vacation or pleasure call few limousine services and you will be surprised to know that the rates are not that high as compaired to Taxi, most of the time its a few dollars more than a taxi and some times even less than a cab. Some of the limo service providers offer shares rides and they are deffinetly less than taxi. Try it next time and see it yourself!!

I knew Arizona’s SB 1070 would be controversial when I introduced it, but I did not expect the national immigration debate to revolve around a state law.
While the anti-American open borders Left attack me and the law as “racist,” “nativist” and their other empty smear words, the vast majority of the people of Arizona and America support the law.

The following article was sent to B.A.N. by Senator Russell Pearce, one of America's greatest border security and anti-illegal immigration advocates, and the author/sponsor of SB-1070.

I knew Arizona’s SB 1070 would be controversial when I introduced it, but I did not expect the national immigration debate to revolve around a state law.
While the anti-American open borders Left attack me and the law as “racist,” “nativist” and their other empty smear words, the vast majority of the people of Arizona and America support the law.
Naturally, politicians of both parties on the state and local level are trying to jump on the bandwagon as the election approaches.
On the state level, dozens of gubernatorial and attorney general candidates are campaigning to enact SB 1070 style legislation. Even Democrats like Georgia’s Roy Barnes say they’d sign such a bill. Of course a politician’s promise isn’t worth the paper it’s written on.
Even if they would in fact sign the bill, they must also pledge to fight the Obama administration and its far left buddies like the ACLU and Mexican American Legal Defense Fund who are sure to file lawsuits and do whatever they can to block implementation of the law.
On the federal level, just saying “I support SB 1070” is even emptier without any commitment to fight the open borders agenda of the Obama administration and the courts.
Any Senate candidate who supports SB 1070 needs to guarantee that they will vote against any activist judge. Any RINO who voted for a board member of “LatinoJustice” (which filed an amicus brief against SB 1070) like Sonia Sotomayor knew how she would vote on immigration cases.
Additionally there is legislation that can affect the legal challenges against SB 1070.
Sen. Robert Menendez’s Comprehensive Immigration Reform Act of 2010 would try to nullify every single state and local law that fights illegal immigration. Congressman Luis Gutierrez’s CIR ASAP Act with over 100 Democratic co-sponsors does the same thing.
Menendez’s bill also restricts the 287(g) program to allow state and local law enforcement to enter into formal agreements with federal immigration authorities to fight illegal immigration. Gutierrez’s bill completely repeals it.
287(g) is a useful program, but it is unfortunately viewed by many as a permission slip that must be granted by the federal government to allow states and localities to enforce immigration law. Former INS Commissioners Doris Meissner and James W. Ziglar wrote an Op Ed in the Washington Post claiming that SB 1070 is unconstitutional because it goes beyond what is permitted by 287(g).
Obama and Janet Napolitano restricted the agreement so that it can only be used to enforce the law against illegal aliens who also commit other crimes, and unfortunately many local law enforcement agencies stopped pursuing the law.
When Maricopa County Arizona Sheriff Joe Arpaio cracked down on illegal immigration without getting permission from Obama, they threatened to revoke his 287(g) status. When Sheriff Joe refused to balk, they filed suit against him with a frivolous civil rights claim.
The truth is that Section 287(g) of the Immigration and Nationality Act explicitly acknowledges that states have the inherit authority to enforce immigration law stating:
"Nothing in this subsection shall be construed to require an agreement . . . in order for any officer of a State . . . to communicate with the [Secretary of Homeland Security] regarding the immigration status of any individual . . . or otherwise to cooperate with the [Secretary] in the identification, apprehension, detention, or removal of aliens not lawfully present in the United States."
Rep. Marsha Blackburn’s Clear Law Enforcement for Criminal Alien Removal [CLEAR] Act further clarifies the states’ rights over immigration by “reaffirming the existing inherent authority of States…to investigate, identify, apprehend, arrest, detain, or transfer to Federal custody aliens in the United States…for the purposes of assisting in the enforcement of the immigration laws of the United States in the course of carrying out routine duties. This State authority has never been displaced or preempted by Congress.”
I’m flattered that my law has become a litmus test on immigration, but I hate to see Democrats and RINOs pretend to defend it to win votes. In Arizona a number of vulnerable Democratic Congressmen including Gabrielle Giffords and Ann Kirkpatrick tried to sound tough by opposing the federal lawsuit with much fanfare. Yet these same Democrats opposed SB 1070 initially, and they refuse to defend Arizona’s right to enforce the law. Rather they simply demand that the federal government take action (i.e. amnesty.) Needless to say, they have not co-sponsored the CLEAR Act.
With friends like these, SB 1070 does not need enemies. Any candidate or politician on the federal level who claims to support SB 1070 needs to put their money where their mouth is. This means supporting the CLEAR Act and acknowledging a state’s inherit right to enforce the law, opposing activist judges, and demanding that the federal government enforce all laws.
Of course the federal government needs to enforce its own laws and secure the border. But until they do, the least we can ask of them is not to interfere with states that care about the rule of law.

- To force upon tax-paying citizens the burden of supporting an infrastructure subjected to abuse by illegal aliens is preposterous and fiscally irresponsible and irrational. Our country is,indeed, a 'melting pot' and our forefathers specifically intended it to continue to be so. The rights granted to citizens (and certain resident foreigners) under the law and, especially the constitution, do not apply to illegal aliens. Period. They have no valid claim to protection under our laws or constitution. Period. I have no problem with someone coming to America and enjoying the benefits of our democracy - as long as it is done legally, they assimilate into and become a productive member of society, and pay their fair share of taxes. We can not and should not over-tax our already overburdened infrastructure and economy by extending amnesty to those who are here illegally. Someone who disregards the laws of this country, including immigration law, does not deserve amnesty simply by virtue of already being here illegally. It is an argument that is false in its' very premise. NO AMNESTY - PERIOD!

One of the latest gruesome killings occurred in Chandler, Arizona, just miles from the home of BanAmnestyNow.com founder/president Sean McCaffrey. The victim was stabbed and beheaded in a manner authorities believe is consistent with the violent assassinations carried out by sicarios, the Spanish word for contract killer.
In a related news story, Sheriff Joe Arpaio noted, “In my jail today we have almost 100 people charged with murder and they're all illegally here. Plus many other violent crimes. If they were not in this country we would not have 18 percent of the people in the jails here that have many violent crimes.”
President Barack Obama has declined or ignored repeated invitations, including those from BanAmnestyNow.com, too visit the Arizona border. As a result of Mr. Obama’s apathy, the man called “Dude” by Jonathan Stewart can’t possibly understand what citizens in border states must contend with.

When federal agents raided a chain of Chuy’s Restaurants across Arizona and California, more than 40 illegal aliens were arrested, along with several of the chain’s top executives were arrested, including the father-and-son owners and their accountant. Yes, LA RAZA & CO will scream and moan, but the illegal aliens apprehended here, aren't the victims. Neither are the business owners accused of breaking the law. The real victims are the legal employees whose jobs will be lost because their employer refused to obey the law.

The Department of Homeland Security is designed to keep our borders strong, our country safe, and to enforce our immigration laws. Under Obama and Janet Napolitano, however, the DHS is not guided by any of these key values, but rather, by their own self-serving agenda... regardless of how unfair that agenda is to U.S. citizens. Recently, Napolitano actually went so far as to claim that Congress must pass the DREAM Act because the DREAM Act will make our borders stronger and will allow DHS to "do its job of enforcing the nation's immigration law."

In addition to suing the state of Arizona, Obama's Justice Department has given over $60 million to Sanctuary Cities across the United States. In this year alone, Obama’s Justice Department has funneled approximately $62.2 million into cities, counties, and states that offer sanctuary to illegal aliens.
